Umbray Store — Terms & Conditions

This is an English translation provided for convenience. The Polish version of these Terms (Regulamin) is legally binding for consumers in Poland; in case of any discrepancy, the Polish version prevails.

§1 General provisions

  1. The online store at umbray.store ("the Store") is operated by Anton Abrosymov, Tax ID (NIP): 5273108667, REGON: 528382814, registered address: Józefa Sowińskiego 25/250, 01-105 Warszawa ("the Seller"), a sole proprietorship registered in Poland.
  2. Contact: hello@umbray.store.
  3. These Terms govern use of the Store, conclusion of distance sales contracts, payment, delivery, withdrawal, and complaints.
  4. The Store sells products of its own design and production (3D-printed lamps) to customers in Poland and, where offered at checkout, other countries.
  5. These Terms' consumer-protection provisions (right of withdrawal, statutory warranty) apply to consumers under Polish law and, where applicable, to sole traders concluding a contract not of a professional nature for them.

§2 Definitions

  • Store — the umbray.store website through which the Seller sells its products.
  • Customer — any person or entity placing an order through the Store.
  • Consumer — a Customer who is a natural person making a purchase not directly related to their business or professional activity.
  • Product — the lamp and its configured variant as presented in the Store.
  • Contract — the distance sales contract for a Product concluded between the Customer and the Seller through the Store.

§3 Placing and accepting orders

  1. Orders may be placed at any time through the order form in the Store.
  2. The Customer configures the Product (e.g. number of legs, leg and shade color), provides shipping details, and selects a payment method.
  3. Placing an order is an offer to conclude a Contract. The Contract is concluded when payment is confirmed and an order confirmation email is sent to the Customer.
  4. Before placing an order, the Customer is shown the Product's main characteristics, total price (including taxes), delivery cost, estimated delivery time, and information about the right of withdrawal (or its absence, if applicable).
  5. The Seller may confirm an order by phone or email before fulfilling it if there is any doubt about its authenticity.

§4 Prices and payment

  1. All prices shown in the Store are gross prices in Polish złoty (PLN), inclusive of VAT at the rate applicable on the order date (currently 23%).
  2. Delivery cost is added to the Product price and shown before the order is placed; it depends on the delivery method and destination country.
  3. Payments are processed via Stripe, including by card, Przelewy24, BLIK, and any other method shown in the Store at checkout.
  4. The Seller does not store card payment data — this is processed exclusively by the payment provider.
  5. On request, sent to hello@umbray.store with billing details, the Seller issues a VAT invoice via Poland's e-invoicing system (KSeF).

§5 Delivery

  1. Orders are fulfilled within 2–4 business days of the Contract being concluded, unless stated otherwise for a specific Product.
  2. Delivery is carried out by carriers selected by the Seller (e.g. InPost, domestic/international courier, Poczta Polska), depending on the destination country.
  3. Delivery cost is shown at checkout and depends on the destination country (Poland / EU / rest of world) and the parcel's weight/dimensions.
  4. The Seller is not liable for delays caused by circumstances beyond its control (carrier delays, force majeure, customs procedures for deliveries outside the EU).
  5. For deliveries outside the European Union, the Customer may be responsible for additional customs duties or taxes charged by the destination country, independent of the Seller.

§6 Right of withdrawal (consumers)

  1. A Consumer who has concluded a Contract at a distance may withdraw from it within 14 days without giving any reason and without cost, except as noted in paragraph 6 below.
  2. The withdrawal period expires 14 days after the day the Consumer (or a third party other than the carrier, designated by the Consumer) takes possession of the Product.
  3. To withdraw, the Consumer must inform the Seller of the decision by an unambiguous statement — in writing to Józefa Sowińskiego 25/250, 01-105 Warszawa or by email to hello@umbray.store. The Consumer may (but need not) use the model withdrawal form in Annex 1 to these Terms.
  4. Sending the statement before the deadline is sufficient to meet it.
  5. Upon withdrawal, the Seller refunds all payments received from the Consumer, including the original delivery cost (except any extra cost from a delivery method chosen by the Consumer other than the cheapest standard delivery offered by the Store), without undue delay and in any case within 14 days of receiving the withdrawal statement. The refund is made using the same payment method the Consumer used, unless the Consumer expressly agrees otherwise.
  6. The Seller may withhold the refund until it has received the returned Product back, or proof that it has been sent back, whichever occurs first.
  7. The Consumer must send the Product back without undue delay and within 14 days of notifying the Seller of the withdrawal, to Józefa Sowińskiego 25/250, 01-105 Warszawa. The Consumer bears the direct cost of returning the Product.
  8. The Consumer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics, and functioning.
  9. Exclusions. Article 38 of the Polish Consumer Rights Act excludes the right of withdrawal, among other things, for contracts where the goods are not prefabricated and are made to the Consumer's specifications or clearly personalized. The Seller does not currently apply this exclusion to the Product's standard configurable options (choosing a color and leg count from a fixed list) — the right of withdrawal described in this section therefore applies to all orders.

§7 Complaints (statutory warranty)

  1. The Seller is liable to Consumers for the conformity of Products with the Contract under the Polish Consumer Rights Act and the Civil Code.
  2. Complaints may be sent to hello@umbray.store or in writing to Józefa Sowińskiego 25/250, 01-105 Warszawa, stating the nature of the defect and the requested remedy (repair, replacement, price reduction, or withdrawal).
  3. The Seller will respond to a complaint within 14 days of receiving it.
  4. The Consumer may request repair or replacement; the Seller may refuse if this is impossible or would require excessive cost. The Consumer may request a price reduction or withdraw from the Contract if the non-conformity is significant or the Seller fails to bring the Product into conformity.
  5. The Seller is liable for a lack of conformity that existed at the time of delivery and becomes apparent within two years of that date.

§8 Personal data

Personal data handling is described in the Privacy Policy, which forms an integral part of these Terms.

§9 Dispute resolution

  1. Consumers may use out-of-court complaint and redress mechanisms, including contacting the relevant Provincial Trade Inspectorate, the standing consumer arbitration court operating alongside it, or a district/municipal consumer ombudsman. Contact details are available at uokik.gov.pl.
  2. The EU's Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025 and is no longer available.
  3. Use of out-of-court dispute resolution is voluntary.

§10 Final provisions

  1. Matters not covered by these Terms are governed by Polish law, including the Civil Code and the Consumer Rights Act.
  2. The Seller may amend these Terms for valid reasons (changes in law, scope of business, payment/delivery methods). Orders placed before an amendment takes effect are fulfilled under the previous Terms.
  3. These Terms are available free of charge on the Store's website in a form that can be downloaded, saved, and printed.
